Child Custody Mediation in DuPage County

Whenever two parents separate, the ordeal is generally more difficult than either anticipated, and their lives are altered dramatically. Added to the stress of negotiating the terms of property division and maintenance, having to decide the care and living arrangements for a dependent child is particularly difficult. Under the Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/609), when parents come before the courts for a divorce, the circuit court will order their participation in mediation to determine child custody

Parental Mediation in Illinois

The Illinois Supreme Court, under Rule 905 of Article IX Child Custody Proceedings, established a program to provide mediation to help parents resolve child-related disputes and come to the right decisions on child custody. This mediation program is applied also to cases involving visitation issues or the removal of a child. The goal of custody dispute mediation is to:

  • Provide parents the services and skills of a professional mediator;
  • Remove the contentiousness in dispute resolution through the mediation process;
  • Foster child-centered negotiations and custody agreements;
  • Resolve disagreements in a parenting plan;
  • Come to an agreement that is fair to both parties; and
  • Write a parenting plan that may be the basis for a workable visitation and custody order.
